These Terms and Conditions (“Terms”) govern your access to and use of https://vintagecollections.online (the “Website”) and every purchase you make from it. The Website is owned and operated by Gaurav Gupta, trading as Vintage Collections by Gaurav Gupta (“we”, “us”, “our”).
By browsing the Website, creating an account, or placing an order, you agree to these Terms. If you do not agree with them, please do not use the Website.
This document is an electronic record under the Information Technology Act, 2000 and the rules made under it, and does not require a physical or digital signature.
1. Who can buy from us
You may use the Website and place orders only if you are:
at least 18 years old, and competent to contract under the Indian Contract Act, 1872; and
purchasing for delivery to an address within India.
If you are under 18, you may use the Website only under the supervision of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your activity. We do not knowingly sell to minors.
We reserve the right to refuse service, cancel orders, restrict quantities, or close accounts at our discretion, including where we suspect fraud, resale abuse, repeated unjustified returns, chargeback abuse, or a breach of these Terms.
2. Your account
You are responsible for keeping your account credentials confidential and for all activity that takes place under your account. Tell us immediately at info@vintagecollections.online if you believe your account has been accessed without your permission.
You agree that the information in your account — particularly your delivery address and mobile number — is accurate, current, and complete. We are not responsible for a failed or misdirected delivery caused by information you gave us.
You may close your account at any time from My Account, or by writing to us. Closing your account does not cancel orders already placed or affect records we are required by law to retain.
3. Products, listings, and condition
3.1 What we sell
We sell pre-owned, refurbished, and collectable mobile phones, consumer electronics, accessories, and vintage collectables, alongside a limited range of new items. Every product page states whether an item is new, refurbished, or pre-owned, its condition grade, what is included in the box, and its warranty position.
3.2 Single units and stock
Most of our stock consists of single, individually sourced units. When an item sells, it is generally gone. We cannot guarantee that a replacement or a second identical unit will be available.
3.3 Descriptions, photographs, and specifications
We describe our products as accurately and honestly as we can. Photographs are of the actual unit unless the listing states otherwise. Screen colours vary by monitor and device, and small variations in shade, finish, packaging, or included accessories are normal for pre-owned goods.
Technical specifications quoted on our pages are taken from manufacturer sources and are provided for reference. Where a manufacturer’s stated specification conflicts with the actual unit, the actual unit and our own listing description prevail.
Cosmetic wear consistent with the stated condition grade is not a defect. See our Return, Exchange & Warranty Policy for full condition grade definitions.
3.4 Network compatibility
Many of our handsets support only 2G or 3G networks, which Indian operators are shutting down. It is your responsibility to confirm compatibility with your operator before ordering. Network incompatibility is not a defect and is not covered by warranty.
3.5 IMEI and provenance
Every mobile device we sell carries an original, unaltered, valid IMEI, which we verify against the Central Equipment Identity Register (CEIR / Sanchar Saathi) before dispatch. We do not deal in stolen, blocked, cloned, or IMEI-tampered devices.
You must not alter, tamper with, remove, or obscure the IMEI of any device purchased from us. Doing so is a punishable offence under Indian law and immediately voids all warranty.
4. Pricing, taxes, and payment
4.1 Prices
All prices are in Indian Rupees (₹) and are inclusive of applicable GST unless stated otherwise. Shipping charges, where applicable, are shown separately at checkout before you pay.
Any “original price”, “MRP”, or struck-through price shown alongside a current price is a reference to the item’s original or comparable market price when new, and is provided for context. It is not a claim that we previously sold that unit at that price.
Prices, offers, and discounts may change at any time without notice. A change does not affect an order we have already accepted.
4.2 Pricing and listing errors
Despite our care, a product may occasionally be listed at an incorrect price, or with an incorrect description or specification. We are not obliged to sell a product at an incorrect price. Where we identify an error before dispatch, we will contact you and give you the choice of confirming the order at the correct price or cancelling it for a full refund. Where a price is obviously and materially wrong, we may cancel the order and refund you in full.
4.3 Payment
We accept the payment methods shown at checkout, which may include UPI, debit and credit cards, net banking, wallets, and Cash on Delivery on eligible PIN codes.
All online payments are processed by a PCI-DSS compliant third-party payment gateway. We do not receive, store, or have access to your full card number, CVV, UPI PIN, or banking credentials. Card details, where saved, are tokenised in accordance with Reserve Bank of India requirements.
Your payment is also subject to your bank’s, issuer’s, and the gateway’s own terms. We are not responsible for a failed, declined, or delayed transaction at their end, though we will help you trace it.
4.4 Invoicing
A GST-compliant tax invoice is issued for every order and sent to your registered email address. If you need a GST invoice in a business name, enter your GSTIN and business details at checkout — we cannot amend an invoice after it has been issued.
5. How a contract is formed
A listing on the Website is an invitation to offer, not an offer.
Placing an order and paying constitutes your offer to buy on these Terms.
Our order confirmation email acknowledges receipt of your order. It does not amount to acceptance.
A binding contract comes into existence only when we dispatch the item to you, and only for the items actually dispatched.
Until dispatch, we may decline or cancel an order in whole or in part — for stock unavailability, a pricing or listing error, a failed pre-dispatch inspection, an unserviceable delivery address, a payment we cannot verify, a suspected fraudulent transaction, or a suspected bulk or resale purchase. Where we do, we refund you in full and tell you why.
6. Delivery, returns, exchanges, and warranty
Delivery, risk, title, transit damage, and delivery timelines are governed by our Shipping & Delivery Policy.
Both are incorporated into these Terms and should be read as part of them.
7. Trademarks, brand names, and no affiliation
This section matters, so we have set it out plainly.
We are an independent reseller of genuine pre-owned and refurbished goods. We are not affiliated with, authorised by, endorsed by, sponsored by, or connected to any of the brands whose products we sell.
Nokia, BlackBerry, Vertu, Motorola, Samsung, Sony Ericsson, Apple, iPhone, iPad, Snexian, and every other brand name, product name, model number, and logo referenced on this Website are the trademarks or registered trademarks of their respective owners. We use them solely in a descriptive and nominative sense, to identify accurately the make and model of the genuine second-hand goods we are offering for sale. No claim of ownership, licence, agency, distributorship, or authorised-dealer status is made or implied.
Consequently:
The goods we sell are pre-owned or refurbished, not new manufacturer stock, unless a listing expressly says otherwise.
Any warranty on a pre-owned item, unless the listing states that a live manufacturer warranty subsists, is given by us and not by the brand.
Brands and their authorised service centres are under no obligation to provide after-sales service, support, spare parts, or software updates for a device bought from us, and we cannot commit them to doing so.
Where a live manufacturer warranty does subsist, it must be claimed directly with that brand’s authorised service centre.
All content on the Website that is ours — our logo, “Vintage Mobiles Collection”, the site design, our photographs, product descriptions, copy, graphics, and layout — is our intellectual property or licensed to us, and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not copy, reproduce, scrape, republish, or use it commercially without our prior written permission.
8. Acceptable use
When using the Website, you must not:
use it for any unlawful, fraudulent, or misleading purpose;
place orders using a false identity, a stolen payment instrument, or another person’s details without authority;
attempt to gain unauthorised access to the Website, its servers, databases, or any account;
introduce malware, viruses, or any harmful code;
use bots, scrapers, crawlers, or automated tools to harvest content, prices, images, or stock data;
resell, redistribute, or commercially exploit our content, product photographs, or listings;
post reviews or content that is false, defamatory, obscene, harassing, infringing, or misleading;
interfere with the Website’s operation or place unreasonable load on our infrastructure;
impersonate us or misrepresent your relationship with us.
We may suspend or terminate access, cancel orders, and take legal action where these Terms are breached.
9. Reviews and user content
If you post a review, rating, image, or comment on the Website, you confirm that it is your own genuine experience, that you own or have permission to post the content, and that it does not infringe anyone’s rights or breach any law.
You grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt, and display that content in connection with the Website and our marketing. We may moderate, edit for length or profanity, decline to publish, or remove content at our discretion. We do not publish paid or incentivised reviews as if they were organic, and we do not filter reviews to remove negative feedback that is genuine.
10. Selling or consigning to us
Where you sell, consign, or trade in a device or collectable to us, you warrant that:
you are the lawful owner and have full right to sell it;
it is not stolen, lost, blocked, or subject to any lien, hire-purchase, EMI charge, insurance claim, or third-party claim;
its IMEI or serial number is original, valid, unaltered, and not blacklisted;
all your personal data, SIM cards, memory cards, and account locks — including iCloud/Find My and Google FRP — have been removed;
everything you have told us about its condition, history, and provenance is true.
We verify IMEIs against CEIR / Sanchar Saathi and retain proof of identity and ownership. Consignment arrangements are governed by a separate written agreement. We may decline any item, and we may report an item to the authorities where we have reasonable grounds to suspect it is stolen.
11. E-waste and responsible disposal
Electronic products and batteries must not be disposed of with household waste. Please hand end-of-life devices and batteries to an authorised collection point, dismantler, or recycler registered under the E-Waste (Management) Rules, 2022.
If you would like to dispose of a device responsibly, contact us at info@vintagecollections.online and we will direct you to an authorised collection point, or accept the device back for channelling to an authorised recycler.
12. Disclaimers
The Website and its content are provided on an “as available” basis. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses, or that any defect will be corrected.
Product information, specifications, historical notes, and compatibility guidance are provided in good faith for general reference and are not professional advice. Independent verification of anything critical to your purchase decision is your responsibility, and we are happy to answer specific questions before you buy.
Nothing in this section limits your statutory rights as a consumer, or our liability for defective, deficient, spurious, or misdescribed goods.
13. Limitation of liability
To the maximum extent permitted by law:
our total aggregate liability arising out of or in connection with any order is limited to the amount you paid for that order;
we are not liable for indirect, incidental, special, punitive, or consequential loss, including loss of data, loss of profit, loss of business, loss of opportunity, or loss of use;
we are not liable for delays or failures caused by events beyond our reasonable control, as described in our Shipping & Delivery Policy.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, product liability under the Consumer Protection Act, 2019, or any other liability that cannot lawfully be excluded. Your rights as a consumer under Indian law are unaffected by these Terms.
14. Indemnity
You agree to indemnify and hold us, our officers, employees, and partners harmless against any claim, loss, liability, or reasonable expense arising from your breach of these Terms, your violation of any law, your infringement of a third party’s rights, or content you post on the Website.
15. Third-party links
The Website links to third-party sites and platforms, including our social media channels. We do not control them, do not endorse their content, and are not responsible for their availability, content, products, or privacy practices. Visiting them is at your own risk.
16. Suspension and termination
We may suspend, restrict, or terminate your access to the Website or your account, with or without notice, where you breach these Terms, where we suspect fraud or abuse, or where we are required to do so by law. Sections that by their nature should survive termination — including intellectual property, limitation of liability, indemnity, and governing law — will continue to apply.
17. Changes to these Terms
We may revise these Terms from time to time. The current version is always published at this URL with its effective date. Changes take effect when published, and apply to orders placed after that date. Orders already accepted are governed by the Terms in force when they were placed. Continuing to use the Website after a change means you accept the revised Terms.
18. Grievance redressal
If something has gone wrong, tell us first — most issues are resolved quickly at this stage.

We acknowledge every complaint within 48 hours of receipt and resolve it within one month. You will receive a ticket reference to track your complaint.

19. Governing law, jurisdiction, and disputes
These Terms are governed by the laws of India.
We will try to resolve any dispute with you directly through our grievance process. Where that does not work, you and we may agree to refer the dispute to mediation under the Consumer Protection Act, 2019, or the Mediation Act, 2023.
Subject to the paragraph below, the courts at New Delhi, India have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
Nothing in this clause affects your rights as a consumer. If you are a consumer within the meaning of the Consumer Protection Act, 2019, you remain entitled to bring proceedings before the District, State, or National Consumer Disputes Redressal Commission having jurisdiction where you reside, work, or where the cause of action arose, and this clause does not require you to arbitrate or to litigate anywhere else.
20. General
Severability — if any provision of these Terms is held unenforceable, the rest remain in full force.
Waiver — a delay or failure by us to enforce any provision is not a waiver of it.
Assignment — you may not assign your rights under these Terms. We may assign ours on a transfer of our business, without reducing your rights.
No partnership — nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
Language — these Terms are drafted in English, which prevails over any translation.
